A METHODOLOGICAL AND ANALYTICAL STUDY OF SELECTED COMMENTARIES ON MUKHTASAR AL-QUDURI AND AL-IKHTIYAR

Abstract

This study provides a concise bibliographical and methodological overview of the major Arabic and Urdu commentaries (Shuruh) and super commentaries (Hawashi) on two benchmark texts of Hanafi jurisprudence: Mukhtasar al-Quduri by Imam al-Quduri (d 428 AH) and Al-Ikhtiyar li-Ta'lil al-Mukhtar by Imam al-Mawsili (d 683 AH) Utilizing a descriptive and comparative research methodology the paper examines how these commentarial traditions unpack legal rulings, articulate juristic reasoning (talil) delineate mufta bih (authoritative) opinions and integrate contemporary legal applications. The study highlights a functional dichotomy between the two linguistic traditions: classical and modern Arabic commentaries primarily preserve systematize and contextualize foundational legal evidence and juristic discourse whereas Urdu commentaries focus on pedagogical simplification textual clarification and institutional utility for contemporary scholars. Ultimately this research demonstrates the enduring vitality of Hanafi commentarial literature in bridging classical legal heritage with modern academic and fatwa needs.
